I, the above PARTICIPANT being above age 18, OR IF UNDER 18 WITH A VALID GUARDIAN’S SIGNATURE hereby acknowledge and agree, on behalf of myself and my heirs, agents, personal representatives and assigns, that:
Skateboarding is a hazardous and dangerous activity that involves strenuous exercise and a considerable degree of skill and experience. I understand that this activity can result in serious bodily injury and damage to property, and I knowingly and voluntarily assume any and all risks of loss, damage or injury while on the premises of The Sanctuary World Outreach Inc./ The Uprising (the "Event") and/or participating in the 2010 The Uprising $1000.00 Best Trick Contest competition (the "Competition").
I am aware of the risks, hazards, and dangers of personal injury, death and disability in entering the Event and participating in the Competition, as well as those risks, hazards and dangers of personal injury, death and disability inherent in participation in any skateboarding activity or event. I am aware that the usual risks, hazards and dangers of personal injury, death and disability increase when using ramps, curbs, steps, half pipes, inclines or declines, bowls or any other such structure or device. I also understand that these risks, hazards and dangers will be further increased because other persons may be using the facilities at the same time and may have a greater or lesser degree of experience or skill than I do. In addition to the usual dangers inherent in this type of activity, there will be the added or increased danger and risk of uncontrollable skate decks, falling, jumping, landing, performing tricks, colliding with other Skateboarders or staff, media personnel and spectators. I am also aware that there is an inherent risk in simply being at the Event and/or observing, photographing or videotaping the Competition.
In consideration for admission to and use of the Event and my participation in the Competition I have agreed to release and forever discharge The Sanctuary World Outreach Inc./The Uprising, as the host of the Competition and each of their respective agents, servants, employees, officers, directors, trustees, corporate parents and/or subsidiaries and all other persons or entities acting on their behalf (collectively, "Covered Parties"), from any and all claims, actions, damages, liability, costs or expenses and attorneys’ fees which are related to, arise out of, or are in any way connected to my participation in the Competition, my use of the Event facilities (either in the interior or the exterior), my use of equipment or property supplied by The Sanctuary World Outreach Inc./The Uprising, or my presence at the Event, regardless of whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of any of the Covered Parties. By signing this Agreement it is my express intention to, (and thus I do hereby), surrender and waive any rights (legal or otherwise) I may have, including the right to sue or exercise any legal right to seek damages from The Sanctuary World Outreach Inc./The Uprising, and/or any other Covered Party.
My presence at and participation in the various activities at the Event, including the Competition, are strictly voluntary and further that no one is forcing me to be present or to participate in any of the activities, including the Competition. I agree not to take any unreasonable risks while at the Event or participating in the Competition including, but not limited to, causing myself, other participants in the Competition, spectators at the Competition and/or other persons present at the Park any unreasonable risk or harm. I additionally acknowledge and agree that I am required to use full protective gear when participating in the Competition and/or otherwise using the Event, including a secure and adequate helmet.
I will comply with all of the stated and customary terms and conditions for participation in the Competition and/or any other activities at the Event. I further agree to indemnify, hold harmless and defend The Sanctuary World Outreach Inc. /The Uprising, any other Covered Parties from any and all claims, actions, damages, liability, costs or expenses and attorney fees whether brought by another Competition participant, a spectator and/or any other third party in connection with or arising out of my presence at the Event and/or my participation in the Competition.
The Sanctuary World Outreach Inc./The Uprising, and all other Covered Parties have my consent and permission to obtain, for and on my behalf, any emergency medical attention and treatment in case of sickness, accident or injury and to secure such medical attention and treatment at my sole expense.
I FURTHER REPRESENT, WARRANT AND CERTIFY THAT: (i) I AM OVER 18 YEARS OF AGE OR IF UNDER 18 WITH A VALID GUARDIAN’S SIGNATURE; (ii) I HAVE CAREFULLY READ THE FOREGOING AND ACKNOWLEDGE THAT I UNDERSTAND AND AGREE TO ALL OF THE ABOVE TERMS AND CONDITIONS; (iii) I HAVE (PRIOR TO SIGNING THIS AGREEMENT), REVIEWED THE EVENT/PARK SAFETY RULES AND REGULATIONS AND HAVE HAD AN OPPORTUNITY TO ASK ANY AND ALL QUESTIONS I MAY HAVE HAD; (iv) I HAVE READ AND UNDERSTAND THIS AGREEMENT AND HAVE HAD THE OPPORTUNITY TO ASK ANY QUESTIONS I MAY HAVE HAD ABOUT THE RIGHTS THAT ARE HEREBY EFFECTED; (v) I AM AWARE THAT BY SIGNING THIS AGREEMENT I ASSUME ALL RISKS AND WAIVE AND RELEASE CERTAIN SUBSTANTIAL RIGHTS THAT I, MY HEIRS, NEXT OF KIN, FAMILY, RELATIVES, GUARDIANS, EXECUTORS, ADMINISTRATORS, TRUSTEES AND ASSIGNS MAY HAVE OR POSSESS AGAINST THE SANCTUARY/THE UPRISING, OR ANY OTHER COVERED PARTY.
